Terms of Service

1. Acceptance of Terms

By accessing or using the Tech-Movematics platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into this agreement on behalf of an educational organization, school, or district, you represent that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Tech-Movematics is a multi-tenant SaaS application designed to digitalize and streamline the lesson planning and compliance verification workflow for educational institutions. The Service facilitates lesson template mapping, creation of lesson plan drafts by teachers, tracking of review milestones, feedback loops, and Kinesthetic AI Suggestions for physical coordination and active learning elements.

3. User Roles and Access Control

The Service operates on a hierarchical multi-tenant architecture. You agree to operate strictly within the boundaries of your assigned role:

• Super Admin: Oversees global infrastructure, manages organizations, manages templates globally, creates subjects/classes, and holds global review authority.
• College Lead (Organization Admin): Configures organization settings, maps templates to classes/subjects, manages organization teachers, initiates review cycles, and approves/rejects lesson plans submitted by their teachers.
• Teacher: Receives review requests, drafts and submits lesson plans based on assigned subjects, and revises/resubmits plans in response to feedback.

You are responsible for maintaining the confidentiality of your account login credentials and are fully responsible for all activities that occur under your account.

4. Content Ownership & License

User Content: All lesson plans, comments, objectives, schedules, and materials uploaded or created by you remain the intellectual property of you or your affiliated educational organization. You grant Tech-Movematics a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, and process your content solely for the purpose of providing the Service.

Platform Content: Tech-Movematics and its original logos, structures, software components, design layout, templates, and Kinesthetic AI suggestions are the exclusive property of Tech-Movematics and its licensors.

5. Acceptable Use and Restrictions

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Upload material that violates third-party intellectual property or privacy rights.
• Circumvent or attempt to disable the multi-tenant access control mechanisms.
• Submit automated query requests or scrape content from the platform without explicit authorization.
• Reverse engineer, decompile, or extract the source code of the Service.

6. Kinesthetic AI Suggestions

The platform includes suggestions powered by Kinesthetic AI. These features are designed to serve as educational recommendations to aid in classroom participation and movement-based lessons. They are provided on an "as-is" basis. Educators hold ultimate responsibility for ensuring that activities are safe, appropriate, and aligned with local educational guidelines.

7. Disclaimer & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. Tech-Movematics does not guarantee that the Service will be uninterrupted, secure, or free of errors. To the maximum extent permitted by law, Tech-Movematics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service.

8. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, if you breach these Terms or if your organization's subscription expires. Upon termination, your right to use the Service will immediately cease.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco, California.
